General Terms and Conditions

For the business relationship between Hotel "Zum Ochsen" and the customer, the following General Terms and Conditions in their respective valid version shall apply exclusively - also for future business. Deviating conditions are only effective if they are confirmed in writing by Hotel-zum-Ochsen.

§1 Conclusion of contract and withdrawal

All offers from the Hotel "Zum Ochsen" are subject to change and non-binding. The contract of sale is concluded when the order has been confirmed by us and the customer has transferred the goods to our account by advance payment. In case of spelling, printing or calculation errors on the website www.hotel-zum-ochsen.de, the hotel "Zum Ochsen" is entitled to withdraw from the contract.

§2 Right of withdrawal

You have a legal right of withdrawal according to § 312 b to 312 d BGB (distance selling law); § 361a BGB. Where people work, errors can occur. Please check our delivery for completeness and defects. You can cancel your order within two weeks after receipt of the delivery without giving reasons in writing or by returning the delivery to our addresses. To meet the deadline, timely dispatch is sufficient. If you return used or damaged goods, we will deduct the legally permissible amount; you can avoid this if you return the goods exclusively inspected and insured in their original packaging and without signs of use. If you make use of your legal right of withdrawal, you have to bear the costs of the insured return shipment for an order value up to EURO 100,- (net).

§3 Delivery

Unless otherwise agreed, delivery is ex warehouse to the delivery address specified by the customer. The risk shall pass to the customer as soon as the delivery has left the premises of Hotel "Zum Ochsen", even if partial deliveries are made. Information about the delivery time is non-binding, unless the delivery date has been promised as an exception.

§4 Due date, payment and delay

The purchase price shall be due immediately, without deduction of any discount, upon placing the order. If the customer is in default of payment, the Hotel "Zum Ochsen" is entitled to charge interest on arrears at a rate of 4% above the discount rate of the Deutsche Bundesbank valid at the time. If the Hotel "Zum Ochsen" can prove that it has incurred higher damages as a result of the delay, the Hotel "Zum Ochsen" shall be entitled to assert such damages.

§5 Offsetting and retention

The customer shall only be entitled to set-off or retention if his claims have been legally established or acknowledged by Hotel "Zum Ochsen".

§6 Retention of title

The delivered goods remain the property of Hotel "Zum Ochsen" until all claims against the purchaser have been settled in full.

 

 

 

§7 Warranty for defects and liability

If there is a defect in the purchased goods for which the Hotel "Zum Ochsen" is responsible, the Purchaser shall be entitled to demand, at its option, that the defect be remedied or that a replacement delivery be made. If this is not possible for the Hotel "Zum Ochsen", the purchaser may withdraw from the contract or demand a corresponding reduction of the purchase price. The warranty period is two years, calculated from the transfer of risk. This regulation does not apply to food or spirits. Here, warranty for defects is excluded from the two-year period, as these are consumer goods.

§8 Data protection

Personal data of the customer will only be collected in accordance with the statutory provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). Hotel-zum-Ochsen uses the data for business relations with the buyer. For this purpose, the provider also reserves the right to have the creditworthiness of our customers assessed by an external service provider to hedge the risk of default. Only the hotel "Zum Ochsen" and friendly companies are allowed to send their interesting offers to our customers.

The change or deletion of personal data is possible at any time by e-mail to info@hotel-zum-ochsen.de.

§9 Applicable law and jurisdiction

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for contracts with merchants is the registered office of Hotel "Zum Ochsen". The company Hotel "Zum Ochsen" is also entitled to sue at the general place of jurisdiction of the customer.
